Court Rulings on Domestic Violence in Ukraine
The courts have received cases against individuals guilty of domestic violence. One of them has already received a verdict.
This has been reported by the police.
Law enforcement officials determined that two men, aged 35 and 58 from the Kodima and Podilsk communities, while under the influence of alcohol, exhibited aggression towards their wives. The women suffered from their verbal insults, yelling, and threats of physical violence.
The police issued reports under parts 1 and 2 of Article 173-2 of the Ukrainian Code of Administrative Offenses against the abusers. The court imposed fines on them.
A resident of the Kodima community filed a lawsuit for a restraining order against her husband to minimize the negative impact of interacting with him. The court decided to prohibit the abuser from approaching the victim, being near her residence, stalking her, or communicating with her for six months. However, the individual disregarded these temporary restrictions and was sentenced in August last year to one year of restriction of liberty with a probation period of one year.
During preventive conversations, the police warned the men about criminal liability for domestic violence. They expressed remorse but continued to terrorize their wives. As a result, they became subjects of proceedings initiated under Article 126-1 of the Ukrainian Criminal Code.
During the pre-trial investigation, sufficient evidence was collected, based on which the investigators charged the defendants with intentionally and systematically committing psychological violence against persons with whom they have family relationships, resulting in psychological suffering and deterioration of the victims' quality of life.
The indictments against the offenders were sent to court, and a decision has already been made regarding one of the abusers from Kodima.
Considering the admission of guilt and the sincere remorse of the defendant, the court found him guilty and imposed a sentence of two years and six months of restriction of liberty with a probation period of two years, partially joining the unserved part of the sentence from the previous verdict. During the probation period, the man must periodically register with the probation authority, report any changes in residence, work, or education, not leave Ukraine without permission, and comply with the measures outlined in the probation program “Overcoming Domestic Violence.”
