Protecting Whistleblower Information: The Importance of Anonymity and Confidentiality

Ensuring the protection of personal data is crucial for safeguarding the rights of whistleblowers. Reporting corruption can be done anonymously or by providing personal information under confidentiality.

It is essential to distinguish between anonymity and confidentiality, as this affects those who wish to report wrongdoing.

The confidentiality of a whistleblower entails prohibiting the disclosure of information about the whistleblower, their relatives, or any other data that could identify them. The organization approached by the whistleblower is required to ensure the protection of such information.

Confidential information includes:

last name, first name, patronymic; date and place of birth; workplace and position; military service details; educational/internship location; information identifying the whistleblower as a business entity; marital status; residential and work addresses; phone numbers, email, other personalized communication channels; photographs of the whistleblower; information about the whistleblower's social media accounts, etc.

Disciplinary, administrative, or criminal liability may arise for disclosing such data, although in certain cases defined by the Law on Prevention of Corruption, such disclosure is not considered a violation.

The right to anonymity allows an individual to report corruption without providing any personal data. Anonymous reports can also be reviewed. The key distinction is that to obtain whistleblower status, protection, and rewards, a person must disclose information about themselves and provide evidence that they made the anonymous report. Security measures, such as ensuring the confidentiality of the individual's information and closed court proceedings, may be implemented to protect the personal data of anonymous whistleblowers.

Everyone has the right to choose how to report corruption based on their motivations and circumstances. It is important to consider these distinctions to avoid misunderstandings and unrealistic expectations.
